Cuccinelli to Ask for Supreme Review of VA Case

02/03/11

Everyone is talking about the multistate case in Florida, but Ken Cuccinelli (VA Attorney General) has announced that he will petition the Supreme Court for a review of his case, Virginia v. Sebelius, under Rule 11.

"Rule 11" allows the Supreme Court to take up a case that is of immediate public importance, even if the case has not been through the normal appeals process.

Here's what Cuccinelli said about this move:

"We did not make this decision lightly.  Given his unique responsibilities to fund and implement Patient Protection and Affordable Care Act as governor of Virginia, Governor McDonnell is particularly concerned about the possibility of wasting precious and strained taxpayer dollars preparing for a law that may well be struck down.  Regardless of whether you believe the law is constitutional or not, we should all agree that a prompt resolution of this issue is in everyone’s best interest."
